1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Jestry's services, including our website, applications, and integrations with third-party platforms such as Shopify (collectively, the "Services"). By installing, accessing, or using the Services, you agree to be bound by these Terms.

2. Eligibility

You may use the Services only if you have the legal capacity to form a binding contract and are authorized to act on behalf of the business or entity that is using the Services.

3. Use of the Services

You agree to:

• Use the Services only in accordance with applicable laws and platform policies;
• Provide accurate and complete information when creating or updating your account;
• Maintain the confidentiality of your account credentials; and
• Promptly notify us of any unauthorized use of your account or security incident.

You are responsible for all activity that occurs under your account and for the actions of your employees, contractors, and agents who use the Services on your behalf.

4. Merchant Responsibilities

If you are a merchant, you are solely responsible for your relationship with your customers, including the sale of products, fulfillment, customer support, and compliance with applicable laws (such as consumer protection and privacy laws). You must provide any required notices and obtain any necessary consents from your customers for the use of our Services on your store.

5. Virtual Try-On Features

Some of our Services may include virtual try-on or similar features that allow customers to visualize products. You are responsible for ensuring that your use of these features is appropriate for your audience and compliant with applicable laws and platform requirements.

Jestry does not permanently store customer pictures used for virtual try-ons.

Customer images processed through virtual try-on features are used solely to generate the try-on experience and are not retained longer than necessary to provide that experience. You must not attempt to circumvent or override these technical and policy limitations.

6. Intellectual Property

Jestry and its licensors retain all rights, title, and interest in and to the Services, including all software, technology, text, graphics, logos, trademarks, and other content provided by us (excluding content that you or your customers provide). No rights or licenses are granted by implication or otherwise except as expressly set out in these Terms.

7. Third-Party Services

The Services may depend on or interact with third-party services, such as e-commerce platforms (including Shopify) or other apps. Your use of such third-party services may be subject to separate terms and conditions. Jestry is not responsible for third-party services and does not control their content or policies.

8. Fees and Payment

If the Services are provided on a paid basis, you agree to pay all applicable fees in accordance with the pricing and billing terms presented to you (for example, through the relevant app store or platform). Fees are generally non-refundable except as required by law or as expressly stated otherwise.

9. Prohibited Activities

You agree not to:

• Reverse engineer, decompile, or attempt to derive the source code of the Services;
• Use the Services to transmit any malicious code or spam;
• Interfere with or disrupt the integrity or performance of the Services;
• Use the Services to violate any law, regulation, or third-party rights; or
• Misrepresent your affiliation with Jestry or the nature of our relationship.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that they will meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by law, Jestry and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Services; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your transmissions or content.

12. Indemnification

You agree to indemnify and hold harmless Jestry and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Services or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, if we reasonably believe that you have violated these Terms, pose a risk to the security or integrity of the Services, or for any other reason permitted by law. Upon termination, your right to use the Services will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your principal place of business, without regard to its conflict of law rules, unless a specific jurisdiction is required by the platform through which you access the Services (for example, Shopify's requirements).

15. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
